TERMS AND CONDITIONS
Plowing
If the town plows, we plow. If a small wet storm comes through with freezing temperatures, we will plow and salt. Any storm lasting more than 24 hours may fall into the next tier.
Staking Property
Place stakes 8’ from the edge of the drive. We will stake property at a cost of $65-$90 depending on length of driveway. Double stake anything of value. If it is not marked and we “find” it, we cannot be held responsible.
DO NOT USE METAL STAKES – wood or fiberglass only. If metal stakes are used and our equipment gets damaged, customer will be charged for all repairs on equipment.
Garages
Drivers will not get closer than 16 inches to a garage/structure to prevent damage. It is the responsibility of the homeowner to remove the remaining snow.
Basketball Hoops
Please either move them out of the way or raise the bottom of the backboard above 8 ft . We will not be held responsible for damage.
Blizzard/Nor'easter
Customer understands that at times service may be delayed beyond the stated time frame due to factors including, but not limited to, the severity of the storm, reduced visibility, rapid snow accumulation rates, mechanical failures, and traffic delays or impassable conditions on municipal roadways, etc. Any storm lasting over a consecutive 24-hr period may be billed at the next tier.
General Snow Removal Terms of Service
The following conditions shall be deemed to be incorporated into any contract between the Client and the Contractor and shall take precedence over any other terms and conditions (unless identified and agreed in writing by the Client/Contractor). Any deletion, substitution or amendment to these terms shall not take place unless agreed in writing by the Contractor and The Client.
Non-Payment
All invoices must be paid within 15 days of invoice due date, unless previously agreed upon terms have been negotiated. In the event that any account becomes more than 15 days past due, Wright Landscapes, reserves the right to cease all service operations until account is brought to current status. Should litigation occur regarding the provisions of this agreement, all litigation expenses, collection expenses, witness fees, court costs and attorney’s fees including appeals shall be paid to the prevailing party.
Call Back
In the event that a return visit is needed because areas could not be cleared during storm; i.e. cars were not moved from spaces or post storm snowdrifts, customer will be charged at the Tier 1 rate based on additional time needed.
Property Damages
Contractor assumes no responsibility for previously existing damages, or damages that occur by factors beyond our control including but not limited to vandalism, natural disasters, extraordinary weather conditions, or other Acts of God. Contractor will exercise reasonable care to avoid damage to grass, pavement, curbs, trees and shrubs. However, Contractor is not responsible for any: a) damage to landscaping caused by the piling of snow, b) damage to items that are snow-covered or not visible, c) damage caused by equipment when tree, grass, shrub and sidewalk areas are not reasonably delineated due to snow accumulation, or d) personal injuries resulting from slip and fall accidents.
Customer is responsible to report, in writing, property damage caused by the contractor within a reasonable time period as conditions allow for site inspection. Contractor shall repair any timely and properly reported property damage as soon as possible, generally in the early spring season following when the damage occurs. Contractor shall have no obligation, and the Customer waives any claim, for any damages not timely and properly reported.
Customer is aware that plowing may not clear their property to bare pavement in all areas and that slippery conditions may prevail even after plowing. Contractor assumes no responsibility for slip and fall accidents or vehicular accidents as a result of this naturally occurring condition.
Pricing
Wright Landscapes has the right to assess cost of doing business depending on the current market. The contract price is based on current prices, however, should the market shift, hereafter specified is considered to be volatile, and sudden price changes could occur, Wright Landscapes reserves the right to pass along said increases to their customers. This includes and is not limited to all products and services.
